Delaware Residency Requirements for Divorce
The court has jurisdiction over the divorce case, provided that the spouses meet the residency requirements. Spouses have the right to file for divorce in Delaware if at the time of the commencement of the action, either party has resided in the state, or has been stationed in the state as the member of the armed forces, continuously for at least six months immediately preceding the dissolution procedure. The divorce must be filed in the county in which either spouse resides.
