Idaho Residency Requirements for Divorce
In order to file for divorce in Idaho, the spouse who initiates the lawsuit (the plaintiff) must meet the residence requirements of the state.
To be eligible to file for divorce in the state of Idaho, the plaintiff must be a resident of Idaho for at least six weeks prior to the commencement of the action.
The plaintiff shall apply for divorce in the county in which either the spouse currently resides.
