New Jersey Residency Requirements for Divorce
To be eligible to file for a divorce in New Jersey, either party must have been a resident of the state for at least a year before the commencement of an action. There is an exception. If a divorce case is based on the fault ground of adultery, there is no time restriction if at least one of the spouses currently resides in New Jersey.
