North Dakota Residency Requirements for Divorce
To be eligible for a divorce in North Dakota, the spouses must comply with the state's residency requirements. North Dakota law says that the divorce may be granted if the claimant was a bona fide resident for at least six months before filing a lawsuit. If the claimant is not a resident of the state, then the marriage can be dissolved on the condition that the claimant is a bona fide resident of North Dakota for six months immediately preceding entry of the decree of divorce.
